1. Acceptance of Terms

By accessing or using the Sonny8 AI-Powered Restaurant Platform ("Service"), operated by BeccaOS LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Sonny8 is a multi-tenant SaaS platform that provides AI-powered ordering, menu management, kitchen display systems, inventory tracking, analytics, and customer engagement tools for restaurants and food service businesses. The Service includes web applications, APIs, and integrations with third-party services.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans & Billing

The Service offers multiple subscription tiers (Free Trial, Starter, Pro, Enterprise). Paid subscriptions are billed monthly or annually through Stripe. You authorize us to charge your payment method on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are available within 14 days of initial purchase.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit harmful, offensive, or misleading content
• Resell or redistribute the Service without authorization

6. Data Ownership

You retain ownership of all data you upload to the Service, including menu items, customer information, order data, and business configurations. We do not claim ownership of your content. You grant us a limited license to process, store, and display your data solely for the purpose of providing the Service.

7. AI & Automated Services

The Service uses artificial intelligence for order processing, voice recognition, and customer interactions. While we strive for accuracy, AI-generated responses may contain errors. You are responsible for reviewing AI-assisted orders and communications. The AI assistant operates within configurable boundaries that you control through your dashboard settings.

8. Third-Party Integrations

The Service integrates with third-party providers including Google (authentication), Stripe (payments), Deepgram (voice recognition), and OpenAI (AI processing). Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for third-party service availability or data practices.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. Enterprise plans include an SLA with specific uptime guarantees and remediation terms.

10. Limitation of Liability

To the maximum extent permitted by law, BeccaOS LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, or data, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

11. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may request an export of your data within 30 days of termination. After 30 days, we may delete your data in accordance with our data retention policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles.
